EFAREWELL PRIVACY POLICY

The eFarewell Privacy Policy describes how eFarewell and its subsidiaries collect and treats user or Personally Identifiable Information (PII) when you use eFarewell services. By using or accessing eFarewell, you are accepting the practices described in this Privacy Policy. Certain postings made while using eFarewell can be viewed by the public and therefore are not considered PII and are not the type of information protected by this Privacy Policy.
eFarewell has been designed for you to share information with your friends and family. We understand that there may be Material that you submit to eFarewell that you may not want everyone in the world to view or read; that is why we give you control of your information and the security levels for your submitted Material through your profile privacy settings. eFarewell believes that you should have control over your personal information. You choose what information you put in your profile, including contact and personal information, photos, videos, and text. And you control the users with whom you share that information through the privacy settings.

Personal Identifiable Information we Collect
- When you visit eFarewell you provide us with PII you knowingly choose to disclose that is collected by us and Web Site use information collected by us as you interact with our Web Site.
- When you register with eFarewell, you provide us with certain PII, such as your name, your email address, your telephone number, your address, your gender and any other personal or preference information that you provide to us.
- When you enter eFarewell, we collect your browser type and IP address. This information is gathered for all eFarewell visitors. In addition, we store certain information from your browser using "cookies." A cookie is a piece of data stored on the user's computer tied to information about the user. We use session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser. By default, we use a persistent cookie that stores your login ID to make it easier for you to login when you come back to eFarewell. You can remove or block this cookie using the settings in your browser if you want to disable this convenience feature.
- When you use eFarewell, we may record information about your usage of the site, such as, but not limited to, other users you communicate with, the frequency and size of data transfers, and information you display about yourself as well as information you click on in eFarewell. If you are logged in, we may associate that information with your eFarewell Account. In order to ensure the quality of our service to you, we may place a tag (also called a "web beacon") in HTML-based customer support emails or other communications with you in order to confirm delivery.
- When you use eFarewell, you may set up your personal profile, send messages, perform searches and queries, participate in group forums, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.
- We may also collect PII about your transactions with us and with some of our business partners. This information might include information necessary to process payments due to us from you, such as your credit card number.
- Any personal information, including, but not limited to, text, photo or video content that you voluntarily submit or disclose online may be collected and used by others.
- If you download the eFarewell Uploader, your copy includes a unique application number. This number, and information about your installation of the Uploader (version number, language) will be sent to eFarewell when the Uploader automatically checks for updates and will be used to update your version of the Uploader.
- You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content.
- Any improper collection or misuse of information provided on eFarewell is a violation of the eFarewell Terms of Use and should be reported to eFarewell immediately.
- By using eFarewell, you are consenting to have your personal data collected, transferred to and processed in the United States.

USES
- If you submit PII to eFarewell, we may use that information to operate, maintain, and improve the features and functionality of eFarewell, and to process any flagging activity or other communication you send to us.
- We do not sell or share your PII with unrelated third parties for their direct marketing purposes.
- We may use your email address without further consent for non-marketing or administrative purposes, such as, but not limited to, notifying you of major eFarewell changes or for customer service purposes.
- We use cookies, web beacons, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit eFarewell; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors and pages viewed; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.
- We may occasionally use your name and email address to send you notifications regarding new services offered by eFarewell that we think you may find valuable.
- Profile information is used by eFarewell primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information by your privacy settings.
- Your profile information, and profile picture thumbnail will be available in search results across the eFarewell network and those limited pieces of information may be made available to third party search engines.
- eFarewell may send you service-related announcements from time to time through the general operation of the service.
- eFarewell may use information in your profile without identifying you as an individual to third parties. We do this for purposes such as personalizing advertisements and promotions.
- We share your information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the service, 2) required by law, 3) we in good faith believe that such action is necessary to or, 4) permitted by you. For example:
- We may provide information to service providers to help us bring you the services we offer. Where we utilize third parties for the processing of any personal information, we implement reasonable contractual and technical protections limiting the use of that information to the eFarewell specified purposes.
- We may be required to disclose user information pursuant to lawful requests, such as 1) subpoenas or court orders, or in compliance with applicable laws; 2) protect, enforce, and defend our Terms of Use, rights and property; (3) protect against misuse or unauthorized use of this Site; or (4) protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions.) This may include sharing information with other companies, lawyers, agents or government agencies.
- If the ownership of all or substantially all of the eFarewell business, or individual business units owned by eFarewell, were to change, your user information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises made in any pre-existing Privacy Policy.

Publicly Available Information
- When you create an eFarewell Account, some information about your eFarewell Account and your account activity will be provided to other users of eFarewell. This may include, but not limited to, the date you opened your eFarewell Account, the date you last logged into your eFarewell Account, and any other information that you choose to make public.
- Through some of the services offered on this Site your postings are available for viewing by all our visitors. Some services allow you to restrict the access through the privacy settings in your profile. Please remember that any information disclosed on a non-restricted eFarewell Service such as, but not limited to, personal information, interests, hobbies, lifestyle choices, groups with whom you are affiliated, comments, messages, photos, videos, or other information, shared with other users in accordance with the privacy settings you select, becomes public information and may be collected and redistributed through the internet and other media channels, and may be viewed by other eFarewell users or the general public and used by others without our knowledge. All such sharing of information is done at your own risk. You therefore should exercise caution when disclosing any Personal Information or PII in these Services.
- Your eFarewell Account name, not your email address, is displayed to other users when you engage in certain activities on eFarewell, such as when you visit support groups, upload videos or send messages through eFarewell. Other users can contact you by leaving a message or comment on the site.
- Removed information may persist in backup copies for a reasonable period of time but will not be generally available to users of eFarewell.
- Where you make use of the communication features of the service to share information with other individuals on eFarewell, however, (e.g., sending a personal message to another eFarewell user) you generally cannot remove such communications.

Your Choices
- If you have an eFarewell Account, you may update or correct your personal profile information, email preferences and privacy settings at any time by visiting your account profile page. If you ask eFarewell to stop using your PII, eFarewell will honor that request while retaining any record of your PII that is necessary to comply with applicable federal, state or local law.
- You may control the information that is available to other users at any time by editing your eFarewell Account and the features that are included in your privacy settings.
- You may, of course, decline to submit certain PII through eFarewell, in which case you can still view public profiles of other users and explore eFarewell, but eFarewell may not be able to provide certain services to you.
- eFarewell may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects PII. This Privacy Policy applies solely to information collected by eFarewell.
- Except as described in this Privacy Policy, eFarewell will get your permission before we use the PII you provide to us in a way that is inconsistent with the purpose for which it was submitted or share your PII with third parties that are not affiliated with eFarewell.

Children Under Age 13
- eFarewell does not knowingly collect or solicit PII from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for eFarewell or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on eFarewell.
- In the event that we learn that we have collected PII from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible.
- If you believe that we might have any information from or about a child under 13, please contact us immediately.
- We recommend that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the Internet.

Advertising on eFarewell
- eFarewell strives to provide you with relevant and useful advertising and we may use third party ad serving systems to do so. We may use a range of information including cookies, web beacons, IP addresses, usage data and other non-personal information about your computer or device (such as browser type and operating system) to provide you with relevant advertising. If you are logged into your eFarewell Account, we may also show you advertising based on the information you have provided to us in your eFarewell Account.
- We use our advertising services to help advertisers and publishers serve and manage ads on this site. Advertisers may serve ads based on interests associated with non-personally identifiable online activity, such as material viewed, frequency of uploading or activity on other third party partner sites. Advertisers may also serve ads to you based on previous activity on that advertiser's website. This non-personally identifiable information is held separately from your eFarewell Account data, or other PII in our possession.
- Other third-party ad serving companies may display ads on eFarewell, provided they comply with our ad serving requirements. You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices. eFarewell’s Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or web sites. Any data obtained by third-party ad servers subsequently shared with eFarewell is maintained and dealt with by eFarewell in accordance with this Privacy Policy.
- Advertisements that appear on eFarewell are sometimes delivered (or "served") directly to users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies to measure the effectiveness of their ads and to personalize advertising content. eFarewell does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on eFarewell unless you choose to share it with them. This Privacy Policy covers the use of cookies by eFarewell and does not cover the use of cookies or other tracking technologies by any of its advertisers.

The security and confidentiality of your PII is extremely important to us. eFarewell takes appropriate precautions to protect our users' information. We have implemented technical, administrative, and physical security measures to protect user information from unauthorized access and improper use. From time to time, we review our security procedures in order to consider appropriate new technology and methods. Please be aware that, although we allow you to set privacy options that limit access to your pages, and despite our best efforts, no security measures are perfect or impenetrable, and no data transmissions over the web can be guaranteed 100% secure. Consequently, we cannot and do not ensure or warrant the security of any information you submit or transmit to us (as defined in the eFarewell Terms of Use) and you do so at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. Because email and instant messaging are not recognized as secure communications, we request that you not send PII to us by email or instant messaging services. Terms of Use, Notices and Revisions
Your use of eFarewell, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use and all of its dispute resolution provisions including arbitration, limitation on damages and choice of law. We reserve the right to change our Privacy Policy and our Terms of Use at any time. From time to time eFarewell may modify this Privacy Policy to reflect industry initiatives or changes in the law, our PII collection and use practices, the features of the eFarewell Services, or technology, and such modifications shall be effective upon posting by eFarewell on the eFarewell Website. Your continued use of the eFarewell Services after eFarewell posts a revised Privacy Policy signifies your acceptance of the revised Privacy Policy. It is therefore important that you review this Privacy Policy regularly to ensure you are updated as to any changes. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.
